the ordination; for it is not possible for those baptized or ordained by such people to be either believers or clerics. 69. If any bishop, or presbyter, or deacon, or subdeacon, or reader, or psalmist does not fast the holy forty days, or Friday, or Wednesday, let him be deposed, unless he is hindered by bodily weakness; but if he is a layman, let him be excommunicated. 70. If any bishop or other cleric fasts with Jews, or celebrates a festival with them, or accepts from them the gifts of the festival, such as unleavened bread or anything of that sort, let him be deposed; but if he is a layman, let him be excommunicated. 71. If any Christian should carry oil to a temple of the gentiles or to a synagogue of the Jews, or lamps, let him be excommunicated. 72. If any cleric or layman should take wax or oil from the holy church, let him be excommunicated, and let him add a fifth part to that which he took. 73. Let no one any longer appropriate for his own use a vessel of silver or gold, or linen, that has been consecrated, for it is unlawful; but if anyone should be caught, let him be punished with excommunication. 74. It is necessary that a bishop who has been accused of something by trustworthy and faithful men be summoned by the bishops; and if he should appear and confess, upon his conviction let the penalty be determined; but if, being summoned, he should not obey, let him be summoned a second time, with two bishops being sent to him; and if he should still not obey, let him be summoned a third time, with two bishops again being sent to him; but if he should even so contemptuously not appear, let the synod declare what seems best against him, so that he may not seem to profit by evading judgment. 75. Do not receive a heretic as a witness against a bishop, nor even one believer alone; "For on the testimony of two or three witnesses every word shall be established." 76. That a bishop ought not, as a favor to a brother or a son or another relative, to ordain whomever he wishes to the dignity of the episcopate; for it is not right to make heirs of his episcopate, bestowing the things of God to human passion; for he ought not to place the Church of God under inheritance. But if anyone does this, let the ordination be invalid, and let him be punished with excommunication. 77. If someone is maimed in the eye or injured in the leg, but is worthy of the episcopate, let him become so; for a blemish of the body does not defile him, but a pollution of the soul. 78. But one who is deaf and blind shall not become a bishop,

Eἴ τις ἐπίσκοπος ἢ πρεσβύτερος ἢ διάκονος ἢ ὑπο διάκονος ἢ ἀναγνώστης ἢ ψάλτης τὴν ἁγίαν τεσσαρακοστὴν οὐ νηστεύει ἢ παρασκευὴν ἢ τετράδα, καθαιρείσθω, ἐκτὸς εἰ μὴ δι' ἀσθένειαν σωματικὴν ἐμποδίζοιτο· ἐὰν δὲ λαϊκὸς ᾖ, ἀφοριζέσθω. ο. Eἴ τις ἐπίσκοπος ἢ ἄλλος κληρικὸς νηστεύει μετὰ Ἰουδαίων ἢ ἑορτάζει μετ' αὐτῶν ἢ δέχεται αὐτῶν τὰ τῆς ἑορτῆς ξένια, οἷον ἄζυμα ἤ τι τοιοῦτον, καθαιρείσθω· εἰ δὲ λαϊκός, ἀφοριζέσθω. οα. Eἴ τις Χριστιανὸς ἔλαιον ἀπενέγκοι εἰς ἱερὸν ἐθνῶν ἢ εἰς συναγωγὴν Ἰουδαίων ἢ λύχνους, ἀφοριζέσθω. οβ. Eἴ τις κληρικὸς ἢ λαϊκὸς ἀπὸ τῆς ἁγίας ἐκκλησίας ἀφέληται κηρὸν ἢ ἔλαιον, ἀφοριζέσθω καὶ τὸ ἐπίπεμπτον προστιθέτω μεθ' οὗ ἔλαβεν. ογ. Σκεῦος ἀργύρου ἢ χρυσοῦ ἢ ὀθόνης ἁγιασθὲν μηδεὶς ἔτι εἰς οἰκείαν χρῆσιν σφετεριζέσθω, παράνομον γάρ· εἰ δέ τις φωραθείη, ἐπιτιμάσθω ἀφορισμῷ. οδ. Ἐπίσκοπον κατηγορηθέντα ἐπί τινι ὑπὸ ἀξιοπίστων καὶ πιστῶν ἀνθρώπων, καλεῖσθαι αὐτὸν ἀναγκαῖον ὑπὸ τῶν ἐπισκόπων· κἂν μὲν ἀπαντήσῃ καὶ ὁμολογήσῃ, ἐλεγχθέντος αὐτοῦ ὁριζέσθω τὸ ἐπιτίμιον· ἐὰν δὲ καλούμενος μὴ ὑπα κούσῃ, καλείσθω καὶ δεύτερον, ἀποστελλομένων ἐπ' αὐτὸν δύο ἐπισκόπων· ἐὰν δὲ καὶ οὕτως μὴ ὑπακούσῃ, καλείσθω καὶ τρίτον, δύο πάλιν ἐπισκόπων ἀποσταλέντων πρὸς αὐτόν· ἐὰν δὲ καὶ οὕτω καταφρονήσας μὴ ἀπαντήσῃ, ἡ σύνοδος ἀποφαινέσθω τὰ κατ' αὐτοῦ δόξαντα, ὅπως μὴ δόξῃ κερδαί νειν φυγοδικῶν. οε. Eἰς μαρτυρίαν τὴν κατὰ ἐπισκόπου αἱρετικὸν μὴ προσδέχεσθε, ἀλλὰ μηδὲ πιστὸν ἕνα· «Ἐπὶ στόματος γὰρ δύο ἢ τριῶν μαρτύρων σταθήσεται πᾶν ῥῆμα.» ος. Ὅτι μὴ χρὴ τὸν ἐπίσκοπον τῷ ἀδελφῷ ἢ τῷ υἱῷ ἢ ἑτέρῳ συγγενεῖ χαριζόμενον τὸ ἀξίωμα τῆς ἐπισκοπῆς χειροτονεῖν οὓς αὐτὸς βούλεται· κληρονόμους γὰρ τῆς ἐπι σκοπῆς αὐτοῦ ποιεῖσθαι οὐ δίκαιον, τὰ τοῦ Θεοῦ χαριζόμενον πάθει ἀνθρωπίνῳ· οὐ γὰρ τὴν τοῦ Θεοῦ Ἐκκλησίαν ὑπὸ κληρονομίαν ὀφείλει τιθέναι. Eἰ δέ τις τοῦτο ποιήσει, ἄκυρος μὲν ἔστω ἡ χειροτονία, αὐτὸς δὲ ἐπιτιμάσθω ἀφορισμῷ. οζ.
